People sometimes assume that they’re not going to be arrested on marijuana charges in Minnesota anymore. After all, cannabis products were legalized in 2023, making Minnesota the 23rd state to adopt these laws as marijuana legalization slowly sweeps across the United States.
This does mean that you’re unlikely to be arrested for simple possession. But it doesn’t mean that there are no laws surrounding marijuana use. There are still many laws and regulations you must follow, so there are a handful of ways you could still face arrest.
Underage use
For example, similar to alcohol, marijuana products have been restricted to those who are 21 and older. Buying them while underage is illegal, as is knowingly selling them to someone underage. Even possession under the age of 21 is illegal, no matter how that possession occurred.
Unauthorized sales
On top of that, the state has set up a system for dispensaries to get the proper license to handle marijuana transactions. Just because cannabis is legal doesn’t mean anyone can sell it. You are allowed to share marijuana products with other people – such as friends or family members who are 21 or older – but you can’t sell the products and receive compensation.
Traveling outside of the state
Tourists sometimes come to Minnesota, especially from states that do not yet have recreational marijuana laws. It is important to know that, even when these products were legally purchased in Minnesota, you can’t take them outside of the state. Driving across state lines is federally illegal, and it’s illegal to fly with cannabis products.
